Discovering that your bank account has been frozen can be alarming, especially when you can no longer withdraw money, transfer funds, or receive your salary.

However, a frozen bank account does not automatically mean that you have committed a crime. In Taiwan, account restrictions may arise from police-reported fraud alerts, derivative account controls, a bank's internal risk assessment, or a judicial seizure order.

Each type of restriction requires a different solution.

Taiwan's Regulations Governing the Management of Deposit Accounts and Suspected Illegal or Obviously Abnormal Transactions were most recently amended on August 31, 2026.

Before attempting to restore access, the first step is to identify why the account was restricted and which authority imposed the restriction.

    1. Why Was My Bank Account Frozen in Taiwan?

     1. Fraud-Alert Accounts

A fraud-alert account is a bank account designated for restrictions following notification from a court, prosecutors' office, or judicial police authority in connection with a criminal investigation.

Once notified, the bank generally suspends transactions involving the designated account. Incoming transfers may also be rejected or returned.Fraud alerts commonly arise in investigations involving financial scams, suspected money mules, identity theft, or unauthorized account use.

Importantly, a fraud alert is not a criminal conviction.

In most cases, the bank cannot independently remove a formal fraud alert without receiving the required notification from the original reporting authority or the applicable restriction period expiring.

     2. Derivative Restricted Accounts

When one account is flagged, other accounts held by the same person may also become subject to derivative restrictions.

These restrictions commonly affect ATM withdrawals, online transfers, and electronic banking services.

Unlike a formal fraud-alert account, certain over-the-counter transactions may remain possible after the bank verifies the transaction's purpose and supporting documents.

The bank may lift derivative restrictions after confirming that the relevant suspicious circumstances have been resolved.

     3. Accounts Restricted by Internal Bank Risk Controls

Banks may independently investigate unusual transactions, including unexpected large transfers, repeated small transactions, sudden activity in a dormant account, or transactions inconsistent with a customer's financial profile.

Depending on the circumstances, the bank may suspend certain services, request additional documentation, or reject suspicious transactions.

Customers may need to provide employment records, contracts, invoices, transaction histories, or proof of the source of funds.

These restrictions are generally reviewed by the financial institution rather than removed through the formal police fraud-alert procedure.

4 Accounts Frozen Under Judicial Orders

Some accounts are restricted because of court orders, prosecutorial seizures, or other legally authorized measures.

These situations require a different approach. The account holder may need to contact the responsible court, prosecutors' office, or enforcement authority and pursue the applicable legal procedure for modifying or lifting the restriction.

The key question is whether the account is subject to a fraud alert, derivative restriction, internal bank control, or judicial seizure.

    2. How to Unfreeze a Bank Account in Taiwan: Five Essential Steps

Step 1: Confirm the Restriction with Your Bank

Contact the bank and ask which account is affected, which transactions are blocked, and whether the restriction originated from a law enforcement agency, judicial authority, or internal bank review.

Where available, request information about the reporting agency, case reference, and required supporting documents.

Keep a record of the notification date and the bank's instructions.

Step 2: Preserve All Relevant Evidence

Do not delete LINE messages, emails, transaction histories, or communications involving the account.

    Collect relevant materials, including:

    ■ Bank statements and transfer records.

    ■ Employment and salary documents.

    ■ Purchase agreements, invoices, and receipts.

    ■ Loan agreements and transaction explanations.

    ■ Messages with individuals who requested access to or use of the account.

If the account was involved in a job offer, loan application, online sale, or request from a friend, prepare a clear chronological explanation of what happened.

Step 3: Apply Through the Reporting Authority for a Fraud-Alert Removal

For a formal fraud-alert account, the removal process generally involves the original reporting authority.

Taiwan's Criminal Investigation Bureau provides information and application procedures for removing fraud alerts.

Depending on the case, supporting documents may include a non-prosecution disposition, acquittal, deferred prosecution disposition, evidence of identity theft, proof of unauthorized account use, or documentation establishing that the original reason for the alert no longer applies.

If several cases or alerts are involved, each relevant restriction should be checked separately.

Step 4: Submit Documents to the Bank for Derivative or Internal Restrictions

Derivative restrictions and internal bank controls are generally reviewed by the financial institution.

Prepare a written explanation supported by documents showing the source, purpose, and legitimacy of the transactions.

If a criminal investigation is underway, consider consulting a lawyer before submitting detailed statements, as explanations provided to the bank may become relevant to subsequent criminal proceedings.

Step 5: Confirm Restoration and Check Credit Information

After the relevant authority issues a removal notification, the bank may still require time to complete its internal processing.

Follow up with the bank to confirm which services have been restored.

You may also request a personal credit report and relevant account-alert information from Taiwan's Joint Credit Information Center (JCIC).

Removal of an account restriction and removal of related credit-information disclosures are separate matters.

According to JCIC's published rules, certain alerts involving acquittals, non-prosecution, identity theft, or mistaken reporting may cease to be disclosed upon removal. Other cases may remain disclosed for a limited period, subject to the applicable rules.

    3. How Long Does It Take to Unfreeze a Bank Account?

A fraud-alert account does not necessarily remain restricted for two years.

Under the applicable rules, the alert generally expires two years after notification unless it is removed earlier.

Where legally justified, the original reporting authority may extend the alert once for up to one additional year.

Therefore, a formal alert may potentially remain effective for nearly three years, but early removal may be possible when the reporting authority determines that the grounds for the alert no longer exist.

Derivative restrictions and internal bank controls do not follow one universal restoration timeline.

Their duration depends on the bank's verification process, the underlying transactions, and whether other restrictions remain in place.

There is no single guaranteed number of days for restoring every frozen bank account in Taiwan.

    4. Can You Withdraw Money or Receive Your Salary from a Frozen Account?

The answer depends on the restriction.

➡︎ A formal fraud-alert account generally has its transaction functions suspended, and incoming transfers may be returned.

➡︎ A derivative restricted account may have its ATM and online banking functions disabled, while certain transactions at a bank branch may still be reviewed individually.

Taiwan's regulations also provide a mechanism under which an eligible person with existing account restrictions may apply for a designated account for employment-related salary payments by providing supporting employment documents.

However, approval is subject to the applicable requirements and the financial institution's review.

Opening such an account does not automatically restore access to the original frozen account.

    5. Does a Frozen Bank Account Mean You Are Guilty of Fraud or Money Laundering?

➡︎ No. An account restriction is not proof of criminal guilt.

However, if an account holder knowingly provides a bank account, ATM card, password, or banking credentials for criminal use, the circumstances may raise questions about fraud, aiding fraud, or money laundering liability.

Under Article 30 of Taiwan's Criminal Code, a person who assists another in committing a crime may be treated as an aider.

In account-related fraud cases, investigators may examine whether the account holder knew or foresaw the risk of criminal use, received compensation, transferred suspicious funds, or helped conceal the destination of criminal proceeds.

    The relevant circumstances may include:

    ■ Why the account was provided or used.

    ■ Whether the account holder knew the other party's identity.

    ■ Whether the transactions were consistent with a legitimate purpose.

    ■ Whether the account holder received payment or commission.

    ■ Whether suspicious activity was reported after discovery.

The presence of fraud-related funds in an account does not, by itself, resolve the question of the account holder's criminal intent.

    6. What If Your Account Was Wrongly Flagged or Opened Through Identity Theft?

➡︎ If an account was opened without your authorization, misused by another person, or incorrectly reported, promptly contact the bank and the relevant police authority.

Gather evidence such as identification records, account-opening documents, police reports, identity-theft notifications, and records showing that you did not authorize the transactions.

You should also verify when the account was opened, which transactions triggered the restriction, and whether your identity or mobile phone information was compromised.

Where appropriate, obtain your JCIC credit information and ask the reporting financial institution to investigate inaccurate records.

A clear, documented explanation is more effective than simply stating that the account does not belong to you.

    7. What Should You Avoid After Your Bank Account Is Frozen?

Avoid transferring suspicious funds through friends or relatives to bypass restrictions.

Do not delete conversations, transaction records, fabricate documents, or submit false explanations to the bank or investigators.

These actions may complicate the financial trail and additional legal risks.

You should also respond promptly to legitimate requests from the bank, police, or prosecutors. If you cannot attend a scheduled interview, contact the responsible authority about the appropriate procedure.

Preserving evidence and providing accurate information are essential to protecting your legal position.

    8. How Can a Taiwan Lawyer Help with a Frozen Bank Account?

Frozen bank account cases may involve both financial regulations and criminal investigations.

enlightened Chien Sheng International Law Firm assists clients with identifying the source of restrictions, reviewing transaction histories, organizing supporting evidence, and assessing potential fraud or money laundering allegations.

Legal assistance may include preparing explanations for financial institutions, reviewing fraud-alert removal procedures, addressing unauthorized account use, and providing representation during police questioning or prosecutorial investigations.

Early legal review can help prevent inconsistent statements, missing documents, and misunderstandings about how the account was used.

Nevertheless, the decision to lift a restriction belongs to the responsible authority or financial institution under the applicable legal framework. No lawyer can guarantee immediate restoration or a particular criminal case outcome.

    9. Frequently Asked Questions About Frozen Bank Accounts in Taiwan

Q1: Does a frozen bank account mean I am under criminal investigation?

Not necessarily. Internal bank restrictions may arise without a formal criminal case. A police-reported fraud alert, however, is generally connected to an investigation. Your exact legal status must be confirmed from the relevant case records.

Q2: Can I ask my bank to remove a fraud alert directly?

Usually not. Formal fraud alerts generally require removal through the original reporting authority or expiration under the applicable rules.

Q3: Can a bank lift derivative account restrictions?

Yes, where the bank verifies that the relevant suspicious circumstances have been resolved and the applicable requirements for lifting the restrictions are satisfied.

Q4: Must I wait two years for my account to be restored?

No. Early removal may be possible. The general two-year alert period is not a mandatory waiting period in every case.

Q5: Can a lawyer help me unfreeze my account?

Yes. A lawyer can review the restriction, organize supporting documents, assist with communications, and address related criminal proceedings. However, restoration is not guaranteed.

Q6: Why was my account frozen after I lent it to a friend?

If the account was used to receive suspected fraud proceeds, it may be flagged or restricted. Whether you face criminal liability depends on your knowledge, intent, involvement, and the available evidence.

Conclusion: Identify the Type of Restriction Before Applying for Removal

If your bank account is frozen in Taiwan, the most important first step is determining why the restriction was imposed.

➡︎ A formal fraud-alert account, derivative restricted account, internal bank risk-control measure, and judicial seizure order each require different procedures.

Account holders should preserve transaction records, identify the responsible authority, prepare accurate supporting documents, and monitor the progress of any removal application.

If the restriction is connected to a fraud or money laundering investigation, obtaining legal advice early may help protect your rights and prevent avoidable mistakes.

➡︎ A frozen account does not automatically establish criminal guilt, but resolving the restriction requires understanding both the banking rules and any related legal proceedings.
