I. Introduction: One Seed, Two Very Different Legal Outcomes
In the cabinets of traditional Chinese medicine shops, there is a long-used medicinal herb known as Huo Ma Ren. For hundreds of years, it has been used to moisten the intestines, relieve constipation, and nourish the body. In the racing pigeon and pet breeding communities, Huo Ma Ren is also regarded as a premium feed that enhances physical stamina, and is even referred to by pigeon enthusiasts as “Viagra for pigeons.”However, this seemingly ordinary seed is in fact closely related to cannabis, a Category 2 narcotic under Taiwanese law. If it is improperly processed or used in the wrong way, it may instantly change from a lawful medicinal herb or animal feed into a prohibited substance under the Narcotics Hazard Prevention Act.Based on Chien Sheng International Law Firm’s practical experience in handling drug-related criminal cases, we have encountered many cases in which individuals unknowingly violated the law because they did not clearly understand the legal status of Huo Ma Ren. This article will explain the legal boundary of Huo Ma Ren from three perspectives: botany, legal regulations, and practical case examples.II. Huo Ma Ren and Cannabis Seeds: Are They Actually the Same Thing?
This is one of the most common questions among the public. The answer is: in essence, Huo Ma Ren is the seed of the cannabis plant. From a botanical perspective, Huo Ma Ren refers to the dried mature fruit, or seed, of the cannabis plant, Cannabis sativa L. In other words, Huo Ma Ren and what is commonly called “cannabis seeds” are products of the same plant species. There is no fundamental botanical difference between them.Whether it is called Huo Ma Ren, Da Ma Ren, Ma Zi Ren, or hemp seed, these terms all refer to the seeds produced by the cannabis plant.Since Huo Ma Ren is essentially cannabis seed, why can it be lawfully sold in traditional Chinese medicine shops? The key lies in whether the seed has been roasted or otherwise processed so that it no longer has germination activity.III. Legal Regulations: Whether the Seed Has Been Roasted Determines Legality
According to Article 2, Paragraph 2, Subparagraph 2 of the Narcotics Hazard Prevention Act, and Schedule II attached thereto, cannabis is classified as a Category 2 narcotic. However, the law expressly excludes the following two circumstances:First, the mature stalks and their products of the cannabis plant, excluding resin.Second, products made from the seeds of the cannabis plant that do not have germination activity. The core meaning of this legal wording is that if cannabis seeds have been properly processed, such as by high-temperature roasting or stir-frying, so that they no longer have germination activity — meaning they can no longer be planted and grow into cannabis plants — then such seed products do not fall within the scope of Category 2 narcotics control. Therefore, Huo Ma Ren sold by traditional Chinese medicine shops must be roasted or stir-fried to ensure that the seeds have lost their ability to germinate before they can be considered lawful.Similarly, Huo Ma Ren sold as pigeon feed or pet rodent feed must also undergo the same deactivation process. Otherwise, selling unprocessed cannabis seeds may constitute the illegal sale of seeds of a Category 2 narcotic plant.IV. Lawful Uses of Huo Ma Ren
When Huo Ma Ren has been lawfully roasted and no longer has germination activity, it has several common uses in Taiwan.1. Use as Traditional Chinese Medicine
In traditional Chinese medicine, Huo Ma Ren is classified as a type of herb that moistens the intestines and promotes bowel movements. It has been recorded in classical materia medica texts throughout history. Its main functions include relieving dry-type constipation, nourishing the body, and supporting individuals such as the elderly or postpartum women who suffer from intestinal dryness and constipation. The well-known formula Ma Zi Ren Wan uses Huo Ma Ren as its principal ingredient.Huo Ma Ren sold by traditional Chinese medicine shops must be properly processed, such as by roasting or stir-frying, to ensure that it does not have germination activity.2. Use as Racing Pigeon and Pet Feed
Huo Ma Ren is highly valued in the racing pigeon community and is often called “Viagra for pigeons.” This nickname comes from the belief that Huo Ma Ren is rich in unsaturated fatty acids, including Omega-3 and Omega-6, high-quality protein, and vitamin E.After being fed Huo Ma Ren, pigeons are believed to have improved stamina, fuller and shinier feathers, better flying speed and endurance, and enhanced reproductive ability. Before racing competitions, many pigeon owners increase the proportion of Huo Ma Ren in their pigeons’ diet in hopes of improving performance. In addition, Huo Ma Ren is also a common feed ingredient for parrots, hamsters, pet mice, and other small animals because it is nutritious and highly palatable. However, whether it is sold as racing pigeon feed or pet feed, business operators must ensure that the Huo Ma Ren has been roasted and no longer has germination activity. In the past, some feed store operators privately sold unprocessed raw Huo Ma Ren to satisfy certain pigeon owners who believed that “raw Huo Ma Ren” had higher nutritional value. These operators were later investigated by law enforcement and referred for prosecution for suspected violations of the Narcotics Hazard Prevention Act.V. Legal Risks: From Animal Feed to Narcotics, There Is Only a Thin Line
In practice, cases involving Huo Ma Ren are not uncommon. The main types of legal risks include the following.1. Selling Unroasted Raw Huo Ma Ren
According to past cases investigated by the Taichung Harbor Police Department, some feed store operators sold raw Huo Ma Ren that had not been hulled or roasted.Because such seeds still had the ability to germinate, law enforcement authorities determined that the operators were involved in selling seeds of a Category 2 narcotic plant.Under Article 4, Paragraph 2 of the Narcotics Hazard Prevention Act, a person who sells Category 2 narcotics may be sentenced to life imprisonment or imprisonment for not less than ten years, and may also be fined up to NT$15 million. The criminal liability is extremely severe.2. Purchasing Huo Ma Ren and Planting It
Some individuals purchase Huo Ma Ren from feed stores or online sellers and then attempt to plant it out of curiosity or for personal use.Once the seeds germinate and grow into plants, the conduct may constitute the offense of cultivating cannabis under Article 12, Paragraph 2 of the Narcotics Hazard Prevention Act:“Anyone who cultivates cannabis with the intent to manufacture narcotics shall be sentenced to imprisonment for not less than five years, and may also be fined up to NT$5 million.”In practice, courts have held that the completed offense of cultivation is determined by whether the cannabis has sprouted. It is not necessary for the plant to grow to the point where it can be harvested. In other words, once the seed sprouts, the offense may already be deemed completed.A recent case involved a man surnamed Cheng in Tainan, who purchased pigeon feed containing Huo Ma Ren with germination activity. He selected eight cannabis seeds from the feed and planted them at his residence. Five cannabis plants were successfully grown, and the court sentenced him to five years and six months in prison.3. Processing the Cultivated Cannabis for Use
If a person further harvests and dries the leaves of cultivated cannabis, even if the purpose is merely for personal use, such as making tea or using it for health purposes, the legal risk becomes even more serious.According to practical legal opinions, if the flowers, leaves, or stalks of cannabis are dried by manual or mechanical means to the point that they are easy to use, such conduct may constitute the offense of manufacturing Category 2 narcotics under Article 4, Paragraph 2 of the Narcotics Hazard Prevention Act.The statutory penalty is life imprisonment or imprisonment for not less than ten years. This is far more serious than the offense of cultivation.VI. How to Ensure the Lawful Use of Huo Ma Ren
To avoid unintentionally violating the law, Chien Sheng International Law Firm offers the following practical suggestions.First, purchase from legitimate sources. Whether Huo Ma Ren is used as traditional Chinese medicine or animal feed, it should be purchased from legally registered traditional Chinese medicine shops or feed stores. Buyers should also confirm that the product has been roasted or otherwise properly processed. Do not purchase unprocessed products simply because of claims that “raw Huo Ma Ren has higher nutritional value.”Second, never attempt to plant it. Even if the Huo Ma Ren is labeled as “roasted,” individuals should not attempt to grow it. If the roasting process was incomplete and the seed still has germination activity, once the seed sprouts, the person may be charged with cultivating cannabis, an offense punishable by imprisonment for not less than five years.Third, be careful when importing Huo Ma Ren. If Huo Ma Ren is brought into Taiwan from overseas or purchased through international online shopping, and the importer cannot provide proof that the seeds do not have germination activity, customs authorities may lawfully seize the goods. The individual may also face criminal investigation for smuggling raw materials related to narcotics.Fourth, business operators should establish inspection mechanisms. Feed stores and traditional Chinese medicine shops that sell Huo Ma Ren should establish proper purchase and inspection procedures to ensure that the Huo Ma Ren they sell has indeed lost germination activity. They should also retain relevant inspection records for future verification.VII. Professional Legal Services Provided by Chien Sheng International Law Firm
The application of law in drug-related cases often involves complicated factual determinations and legal interpretation. In Huo Ma Ren-related cases, whether the seeds have germination activity is often the key issue that determines whether the accused is guilty or not. In addition, the subjective intent of the person involved — such as whether the person knew the seeds had germination activity, and whether the person had the intent to manufacture narcotics — is also an important factor considered by the court.
