Being falsely accused of a serious crime in a foreign country can be devastating, especially when facing charges like forced sexual intercourse under Taiwan’s Criminal Code Article 221. In this case, our client, a Ghanaian national detained at Yilan Detention Center, was accused of sexually assaulting a Taiwanese woman. Through swift intervention and meticulous legal strategy, our criminal defense team at Chien Sheng International Law Firm successfully secured a non-prosecution disposition, clearing our client’s name and ending the investigation without trial.

    ► Case Background

Date of Alleged Incident: November 22, 2013

Location: A residence in Sanchong District, New Taipei City

Allegation: The complainant claimed she was lured to the defendant’s residence under the pretense of viewing a rental property, and was then allegedly forced into oral and vaginal intercourse against her will.

    ►Defense Strategy and Key Evidence

    Consent-Based Relationship Denied Criminal Intent

The defendant openly admitted that sexual activity took place but firmly denied any coercion, stating that the complainant was his romantic partner at the time.

Text Messages Revealed an Ongoing Relationship

The defense submitted text message records in which the complainant expressed familiarity and ongoing communication with the defendant, including messages referencing pregnancy, relationship issues, and travel plans — clearly indicating a personal connection rather than a predatory act.

No Physical Injuries or Corroborating Evidence

Medical examination reports showed no signs of physical injury. With no witnesses or external evidence supporting the allegation of force, the prosecution found the complainant’s statement insufficient to sustain criminal charges.

    ► Prosecutor's Decision: Non-Prosecution

After thorough examination of the facts and legal arguments, the New Taipei District Prosecutors Office concluded:

There was insufficient evidence to support the allegation of forced sexual conduct.

The complainant’s account was disputed and uncorroborated.

Text messages and defense statements raised reasonable doubt.

Thus, the prosecutor issued a non-prosecution disposition on May 15, 2025, in accordance with Article 252, Subparagraph 10 of the Code of Criminal Procedure.
